Trustee Letter · Notice of Resumption of Stayed Adversary Proceedings
A fifteen-page letter dated July 18, 2024 from Nicholas Bassett of Paul Hastings, on behalf of Luc Despins in his capacity as chapter 11 trustee in Miles Guo's bankruptcy case in the U.S. Bankruptcy Court for the District of Connecticut, addressed to Judge Analisa Torres. It was filed two days after the jury returned its verdict.
Background
The Trustee had previously moved the Bankruptcy Court for an order staying two adversary proceedings pending the conclusion of the criminal trial:
- Despins v. Ngok, et al. (Adv. Proc. No. 24-5273), referred to in the letter as the "Civil RICO Action";
- Despins v. ACA Capital Group Ltd., et al. (Adv. Proc. No. 24-5249), referred to as the "Omnibus Alter Ego Action".
On March 22, 2024 the Bankruptcy Court entered a Stay Order providing, among other things, that both actions were stayed pending the conclusion of the criminal trial, and directing the Trustee to file a notice of resumption in the Bankruptcy Court and in this Court following the conclusion of that trial, upon which filings the stay would terminate. The Trustee's earlier letter on the subject is at Dkt. 246 (March 5, 2024).
What this filing does
This letter is the notice of resumption the Stay Order required; its effect is to restart the Civil RICO Action and the Omnibus Alter Ego Action now that the criminal trial has concluded.
