摘要
Second Circuit Order · Ranyue Bai Mandamus Denied (December 1 Docket Entry)
This two-page document is the Second Circuit's November 26, 2025 order in In re Ranyue Bai, Case No. 25-2726, denying the pro se mandamus petition. The order was transmitted to the SDNY docket on December 1, 2025.
Panel
The panel consisted of:
- Dennis Jacobs, Circuit Judge;
- Joseph F. Bianco, Circuit Judge;
- Victor A. Bolden, District Judge (sitting by designation).
Petitioner's Requests
Ranyue Bai, pro se, filed a petition for a writ of mandamus directing the district court to:
- Cease suppressing his future filings;
- Docket his submitted but undocketed motions;
- Rule on his pending Federal Rule of Civil Procedure 60(d)(3) motion.
Disposition
Applying Cheney v. U.S. Dist. Ct. for D.C., 542 U.S. 367, 380–81 (2004), the panel denies the mandamus petition because Bai has not demonstrated his right to the writ is clear and indisputable, and that granting the writ is appropriate under the circumstances.
The denial of the docketing-related portion is entered without prejudice to renewal in view of the large number of submissions received by the district court (which the panel "trusts the court will address expeditiously"), if the district court fails to docket the submissions within a reasonable time.
